Terms of Service

These Terms of Service ("Terms") govern use of tinyindulgences.com, the Tiny Indulgences storefront and Recipe Library, and purchases from Tiny Indulgences LLC. By creating an account, placing an order, or using the services, you agree to these Terms.

Eligibility and Accounts

You must be legally capable of entering a binding agreement. You agree to provide accurate information, keep login credentials confidential, and promptly notify us of suspected unauthorized account use. You are responsible for activity conducted through your account unless prohibited by law.

Digital Products and Delivery

Current products are digital recipes and collections delivered to the Recipe Library associated with the account used at checkout. Unless expressly stated otherwise, purchase provides read-only online access rather than ownership of a downloadable file or physical shipment. Access normally begins after payment approval.

Prices and Payment

Prices are shown in U.S. dollars unless stated otherwise. You authorize us and our payment processor to charge the selected payment method for the displayed total. We may correct pricing or product-description errors before completing an order and may cancel or refund an affected transaction.

Final Sale and Refunds

Because digital content is made available immediately and can be viewed or reproduced once delivered, digital purchases are final and non-refundable after access is provided. Our Returns & Refund Policy explains the limited situations in which we will correct an order or provide a remedy. Nothing in these Terms excludes rights that cannot legally be waived.

Personal License and Intellectual Property

Recipes, photographs, designs, text, branding, layouts, books, viewer content, and related materials are owned by or licensed to Tiny Indulgences LLC and are protected by intellectual-property laws. A completed purchase grants one customer a limited, revocable, non-exclusive, non-transferable license to access and use the purchased content for personal, non-commercial household use.

You may prepare and serve the recipes for personal entertaining. You may not reproduce, screenshot for redistribution, publish, upload, share account access, sell, sublicense, distribute, scrape, remove notices from, or create a competing product from the content. Commercial food service, resale, classes, publications, brand partnerships, and other commercial uses require our prior written permission.

Acceptable Use

You may not interfere with the storefront or viewer, bypass access controls, probe security, use automated extraction tools, introduce malicious code, impersonate another person, make fraudulent purchases, or use the services in violation of law or another person's rights. We may suspend access reasonably believed to involve fraud, sharing, abuse, or a material violation of these Terms.

Recipe, Allergy, and Food-Safety Disclaimer

Recipes and presentation guidance are provided for general informational and culinary purposes. Results vary with ingredients, equipment, technique, environment, and substitutions. You are responsible for ingredient selection, allergen review, sanitation, storage, preparation, serving, and compliance with applicable food-safety guidance. Content is not medical, nutritional, or dietary advice. If serving others, disclose relevant ingredients and allergens and use suitable alternatives where appropriate.

Availability and Changes

We work to keep purchased content available, but temporary interruptions may occur for maintenance, security, provider outages, or circumstances beyond our control. We may improve or update the viewer and content presentation while preserving the substance of valid purchases. If we discontinue a service, we will use commercially reasonable efforts to provide notice or an appropriate access alternative.

Third-Party Services

The services rely on third parties for hosting, payments, commerce, and email. Their services and links may be governed by separate terms. We are not responsible for third-party sites we do not control.

Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the services and digital content are provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, or non-infringement. Tiny Indulgences LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or lost data arising from the services or content. To the maximum extent permitted by law, our aggregate liability for a claim will not exceed the amount paid for the product giving rise to the claim.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to any rights that cannot be waived, disputes will be brought in the state or federal courts serving Lee County, Florida, and the parties consent to their jurisdiction.

Changes and Severability

We may update these Terms prospectively by posting a revised version and effective date. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
